GENERAL TERMS AND CONDITIONS

These contractual provisions govern the relationship between the customer and Tamina Therme AG (hereinafter referred to as TT AG), including the sale of tickets and reservations on the website www.taminatherme.ch and at the ticket office. These also apply to the sale of subscriptions.

Persons who contact TT AG in any way, visit the Tamina Therme and access the TT AG website declare that they agree to the following terms and conditions of use in the version applicable at the time:

1. knowledge of the use of electronic means of communication

Users of the TT AG website confirm that they are familiar with the electronic means of communication and are aware of the security risks of electronic traffic. Users undertake to make only lawful use of the means of communication.

 

2 Conclusion of the contractual relationship via the e-commerce platform

The purchase of vouchers and tickets in the online store and the booking of a reservation is made by the customer at www.taminatherme.ch. TT AG sends an electronic confirmation of the order to the customer. The contractual relationship comes into effect when the electronic confirmation is sent to the customer.

 

3. tickets (purchase at the box office or on www.taminatherme.ch)

3.1 Purchase of tickets
By purchasing tickets, ticket purchasers acknowledge the safety, access and other regulations (e.g. house rules) of TT AG. Online tickets may only be purchased from the official website or from authorized partners of TT AG. Furthermore, ticket purchasers acknowledge that they may be excluded from TT AG without compensation in the event of non-compliance with the aforementioned regulations.
 

3.2 Transferable and personal tickets
Online tickets and tickets purchased at the ticket office are transferable, with the exception of personal subscriptions (e.g. annual subscription).

3.3 Handling/damaged tickets
Tickets must be protected from moisture and may not be altered or copied. The validity of the ticket is checked electronically by TT AG (using barcodes or ticket numbers). Tickets whose microstructure or barcode is damaged in any way lose their validity, but can be printed out again from the personal account. In the event of duplicates or fraudulent transactions (resulting in a report to the authorities), TT AG reserves the right to reject all tickets and refund the price to the rightful holders.

3.4 Validity of online tickets 
Online tickets are only valid for the day stated on them and for the services listed. Rebooking or refunds are generally not possible.

 

4 Vouchers

4.1 Purchasing and ordering vouchers
Vouchers are available at the entrance desk or in the Therme Boutique. When ordering vouchers in the online store, the voucher can be obtained online as a PDF document and printed out locally by the customer (Print@Home). The customer is responsible for ensuring that the necessary requirements for printing the voucher are met. The customer shall take the necessary precautions to prevent use by unauthorized persons or misuse (e.g. copying, altering or printing by unauthorized persons). Purchased vouchers may neither be passed on on the Internet or other networks nor used commercially. Printed vouchers must be stored in such a way that all information on the voucher and in particular the voucher number and barcode remain clearly legible. TT AG accepts no liability for damages incurred by the customer as a result of use or misuse by unauthorized persons or due to illegible vouchers.

 

4.2 Period of validity of the vouchers
The gift vouchers can be redeemed in the entire thermal spa (bath, sauna, gastronomy, store, spa treatments). Exceptions are explicit vouchers with a corresponding imprint. The balance query can be requested at any time. Cash payment is not possible. The voucher will not be replaced in the event of loss or theft. The validity period printed on the voucher applies to promotional vouchers (Pro-TT type) given away by TT AG. The credit balance of Pro-TT vouchers expires after the expiration date.

Regularly purchased vouchers are valid for 10 years.

 

5 Refunds

Vouchers will not be taken back by TT AG. Products in perfect, saleable and unopened condition from the TT Shop will be taken back within 10 days (date of invoice) in return for a credit note. Proof of purchase must be presented. In the event of manufacturing defects in products, the items in question will be exchanged for a flawless copy, provided that the customer has checked and returned the product within 10 days of receipt.

 

6 Cancellation policy

Cancellations for booked treatment services, courses and workshops must be received by TT AG at least 24 hours before the appointment. If a cancellation is received less than 24 hours before the booked appointment, TT AG reserves the right to charge for the booked service. Instead of canceling, the booked services may be used by a substitute person sent by the customer. Cancellations must be made by e-mail to info@taminatherme.ch.

 

7 Prices

Prices are quoted in Swiss francs (CHF). If payment is made in euros, the exchange rate applicable on the day of payment shall apply. The prices include statutory value added tax. Prices are subject to change without notice.

 

8 Payment and means of payment

The articles and vouchers remain the property of TT AG until full payment has been made. The amount for subscriptions (e.g. annual subscription) must be paid at the time the contract is concluded or when the contract is renewed. TT AG reserves the right to refuse access to TT AG, to charge reminder fees and to take legal action in the event of outstanding payments.

9 Restricted offer

In the event of restricted usability of TT AG, the purchaser of the ticket has no right to return or exchange the ticket; any such action is generally excluded. In addition, ticket and subscription sales may be discontinued at any time without further justification. In the event of restricted usability of TT AG, the terms and conditions of the annual subscription shall apply to subscription holders.

 

10 Copyright protection

The entire content of the TT AG website is protected by copyright; accordingly, the downloading or printing of individual pages and/or parts of the website is only permitted if the copyright notices and other protected designations are not removed. In the event of downloading or reproduction in any other way, all rights to the information remain with TT AG. Commercial use of the TT AG website or parts thereof is strictly prohibited.

 

11 Data protection

The data protection provisions of the website at www.taminatherme.ch/datenschutz apply.

 

12 Limitations of liability

12.1 Ticketing
TT AG accepts no liability for the accuracy of the information available on the website, in particular not for the correctness, completeness and reliability of the corresponding information. TT AG accepts no liability for damage caused by transmission errors, technical defects, operational failures or unlawful interference with IT systems, irrespective of the location and nature of the interference. Furthermore, TT AG shall not be liable for damage caused by malfunctions, interruptions (including system-related maintenance work) or overloading of IT systems. TT AG is not liable for direct damage or indirect damage (consequential damage) arising in connection with the retrieval of services or queries on the TT AG website. The exclusion of liability also applies to damage caused by links to other websites. TT AG points out in particular that clicking on links may cause you to leave the TT AG website and that TT AG has neither checked the linked sites nor does it accept any responsibility for their content, products, services or other offers. The information disseminated on the TT AG website is intended solely for the private use and information purposes of potential users of the system. Users are aware that the information may be changed at any time and without prior notice.


12.2 Liability regarding the use of the wellness facilities
TT AG accepts no liability whatsoever for damage to property, personal injury or financial loss in connection with the operation of the wellness facilities. The use of TT AG facilities is at the user's own risk. In particular, TT AG is not liable for:
Damage caused by the use of swimming pools, saunas or other spa facilities;

  • Indirect damage caused by third parties (theft, damage to property, injuries sustained while using the thermal baths, etc.);
  • Loss of objects, money or other valuables.
     

This exclusion of liability does not apply if TT AG or its staff can be proven to have acted with intent or gross negligence.


12.3 Liability regarding participation in courses and workshops
TT AG accepts no liability whatsoever in the event of concealment of any physical or mental ailments for which participation in courses and workshops is not advisable. Furthermore, the participant(s) shall not be liable to TT AG for any health or medical problems that may arise as a result of the course. The customer is therefore responsible for taking out adequate insurance cover. TT AG reserves the right to reject participants if the course management is of the opinion that the health or psychological requirements for participation in the course are not met. This refusal can also be made at short notice or during ongoing courses. In the event of the participant's refusal, the course fee will be refunded to the participant.

 

13 Amendments/additions

TT AG may amend and supplement these GTC at any time. The version published online at the time of electronic confirmation by TT AG shall apply.

 

14 Law and place of jurisdiction

This contractual relationship is governed by Swiss law (excluding private international law). The exclusive place of jurisdiction is Bad Ragaz.
